Departmental Overview

As a national collegiate leader, the University Health Services' Tang Center provides comprehensive medical, mental health, insurance and health promotion services to all UC Berkeley students, and a variety of health programs for faculty and staff. Services are designed to minimize the impact of illness, emotional distress and injury on studies and work. UHS provides on-campus medical and mental health care and coordinates supplemental needs for off-campus care through a network of community specialists and hospitals. Departments serving students include general medical, specialty and urgent care clinics, counseling and psychological services, laboratory, pharmacy, physical therapy, radiology and health promotion. Responsibilities
The Privacy Officer is responsible for documenting, triaging, and coordinating appropriate response for privacy breaches within University Health Services (UHS) or its affiliated branches. As the Privacy Officer for UHS, incumbent ensures compliance with federal and state laws regarding patient privacy and security. Also responsible for the acquisition, analysis, storage, retrieval and release of medical and related information. Serves as the back up to the Lead Release of Information Officer for Medical Records. Under manager supervision, facilitates the flow of patient health information throughout UHS, working with directors and managers to identify information needs, establish processes for efficient transfer of information, and incorporates strategic organizational initiatives into the flow of health information throughout UHS. Responsibilities include:

Privacy:
1. Provides subject-matter expertise in applicable regulatory standards including federal and state privacy laws, accrediting agencies, and campus policies. Maintain current knowledge of applicable federal and state privacy laws. Acts as a resource for all of UHS, campus, and intercampus working groups.
2. Point of contact for research of breaches and potential breaches of privacy.
3. Oversee the development and implementation of UHS policies and procedures for carrying out the requirements of the University's system wide privacy standards and implementation policies and the education of UHS workforce; creates and maintains information and training materials for UHS staff in alignment with evolving regulations.
4. Develops educational materials for protecting patient privacy; plans and executes communications and trainings with staff, especially onboarding for new staff; Maintain evidence of all privacy training documentation for volunteers and new employees for 7 years.
5. Serves on internal committees and intercampus working groups requiring subject-matter expertise, advocating UHS interests as needed; Serves on system-wide HIPAA Privacy Officers Workgroup.
6. Assure that HIPAA-required mitigation, compliant, and sanction standards and policies are implemented and documented.
Document all breach incidents according to the University of California guidelines. Follow Breach Notification Rules as outlined by the Department of Health and Human Services and work with appropriate campus partners as required.

Medical Records:
1. Evaluates Medical Records Department efficiency and effective compliance with electronic medical records management including content management, organization and access, and coordination of records for patient care.
2. Back up to Lead Release of Information Office for Release of Information Requests: Responsible for documentation of release requests, triage/delegation by disclosure type (e.g. subpoena, personal use, continuation of care, etc.). Collaborates with mental health department when release requires dual input (medical and mental health). Queries general counsel when questions arise about UHS or when UHS employees are named in legal requests. Personally reviews and prepares for release any complex or non-standard subpoenas, court orders, or other requests and seeks consultation when appropriate.
3. Establishes and updates policies and practices for an annual audit of UHS access of Personal Health Information (PHI) to ensure releases are in compliance with federal and state laws and University policies.
4. Develops, coordinates, and executes (with manager approval) schedule to purge records, according to all application documentation retention rules for students, minors, staff, etc. Coordinates with mental health, occupational health and social services departments for purging of co-mingled mental and medical health records.
5. Provides guidance to clinical staff when charting addenda are needed in electronic health record. Coordinate all potential PII and PHI concerns that result in such documentation by way of: walkout state, claim submitted to third party payer, clinical decisions made or referrals sent to outside provider.
6. Back up to Lead Release of Information Officer on management of high risk records (electronic health record and paper chart) issues, reporting and escalating appropriately. Collaborates with Health Information Manager, Medical Director, Assistant Medical Director and Risk Manager in the sequestration of select records when needed. Take initiative to plan and coordinate access controls with colleagues, implementing checks and balances in collaboration with team. Develops metrics regarding privacy issues, benchmarks, and reports out.
7. Back up to Lead Release of Information Officer in handling complex customer service issues that arise for individuals seeking record releases or record corrections.

Back Up Department Lead:
1. Assist manager and Lead Release of Information Officer with ensuring efficient operation of Medical Records department.
2. Orient new clinical staff to medical records unit and electronic medical record procedures.
3. Assess and monitor the workflow of the unit and recommend strategies to maximize quality and efficiency.
4. Ensure Medical Records forms are in compliance with applicable state and federal laws/policies and University regulations.
Assist manager in creating and implementing plans to enhance staff skills.

Required Qualifications
Knowledge and Skills:
• Thorough knowledge in the following areas: risk management; insurance; forecasting and analysis; accounting; knowledge of common campus-specific computer application programs; knowledge of campus processes and procedures; understanding of campus rules and regulations.
• Knowledge of the HIPAA Privacy Rule and California state laws regulating privacy and confidentiality of health information.
• Requires interpersonal, service oriented, active listening and critical thinking skills.
• Requires ability to present complex risk findings and make recommendations in a clear concise manner both in writing and verbally.
• Strong skills in short term planning, analysis and problem-solving and customer service.
• Strong collaborative and communication skills to interface departmental services with other faculty, staff, student and community programs.
• Preferred knowledge of medical coding systems (CPT, ICD-9, ICD-10, HCPCS, etc.).
• Demonstrated ability to develop interpersonal relationships that contribute to workplace effectiveness.
• Demonstrated initiative and resourcefulness.
• Ability to set priorities, and creativity in problem solving.
• Demonstrated ability to facilitate teams and committees effectively.
• Demonstrated ability to work with and in a diverse environment.

Education/Training:
• Bachelors degree in related area and/or equivalent experience/training
• 3-5 years experience in confidential records management and/or privacy compliance
• Working knowledge of student health services and occupational health preferred

Licenses or certifications:
• Registered Health Information Technician preferred
